WAIVER OF SERVICE

I. ACKNOWLEDGMENT OF MEDICAL CARE
I certify that I am under the care of a licensed physician or health care provider for all medical diagnoses, input, and recommendations related to my pregnancy. I acknowledge that this entertainment ultrasound is not a replacement for, nor intended to substitute, standard medical care.
 

II. PURPOSE OF ULTRASOUND SERVICE
I certify that I am obtaining this 2D/3D/4D ultrasound solely for entertainment purposes. This ultrasound is not intended to replace or serve as a substitute for medical diagnostic procedures or assessments.

III. PRIOR MEDICAL DIAGNOSTIC ULTRASOUND
I confirm that I have undergone a medical diagnostic ultrasound as prescribed by my health care provider. This diagnostic ultrasound included, but was not limited to, the confirmation of my due date, screening for fetal abnormalities, and/or identifying any pregnancy-related concerns.

IV. TERMS AND CONDITIONS OF ENTERTAINMENT ULTRASOUND SERVICE
As a condition of receiving this entertainment ultrasound from Westbank 3D Ultrasound, I voluntarily acknowledge, understand, and agree to the following:

1. Non-Medical Nature

   • This ultrasound is an elective, non-medical procedure performed at my request for personal entertainment purposes only.

   • The technician conducting this procedure is not a licensed medical professional (doctor or nurse) and is not qualified to provide medical diagnoses, interpret medical images, or draw medical conclusions from the session.

   • No radiologist or physician will review the images obtained during this session.

2. Scope of Service

   • The purpose of the ultrasound is limited to providing a keepsake view of fetal movements.

   • This service does not include medical assessments, evaluations of fetal well-being, or any diagnostic findings.

   • I understand that I am responsible for contacting my health care provider for any concerns regarding my pregnancy or the ultrasound session.

3. Quality of Images and Results

   • The quality of the ultrasound images depends on various factors, including maternal body habitus, fetal position, developmental stage, and fluid levels.

   • Westbank 3D Ultrasound does not guarantee the quality of the images, the ability to visualize fetal characteristics, or the determination of fetal gender.

   • I acknowledge that factors beyond Westbank 3D Ultrasound's control may affect the accuracy of any gender determination or visualization.

4. Use of Media

   • I give Westbank 3D Ultrasound permission to use any still or moving images obtained during my session for advertising purposes. No names will be released or associated with these images.

5. Assumption of Risk

   • While ultrasound is generally considered safe for mothers and fetuses, I understand there may be unknown risks or adverse effects that current research has not identified.

V. RELEASE OF LIABILITY AND INDEMNITY
In consideration of the services provided:

1. I release and hold harmless Westbank 3D Ultrasound, its agents, and employees (the "released parties") from any claims or causes of action for injury, harm, loss, or damage arising out of this elective ultrasound service, whether caused by negligence or otherwise.

2. I release and hold harmless the released parties from claims or causes of action resulting from the failure to accurately determine fetal gender or any other fetal characteristics.

3. I agree to indemnify and defend Westbank 3D Ultrasound against any complaints or claims related to this service.

VI. ARBITRATION AGREEMENT
Any disputes or disagreements arising from this service will be resolved through binding arbitration in the state of Louisiana.
